Tenor

1.

Das europäische Patent 1 223 660 wird für das Hoheitsgebiet der Bundesrepublik Deutschland im Umfang der Patentansprüche 1, 2, 3 sowie 5, 6, 7 und 8, soweit diese nicht unmittelbar oder mittelbar auf Patentanspruch 4 rückbezogen sind, für nichtig erklärt.

2.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist im Kostenpunkt gegen Sicherheitsleistung von 120 % vorläufig vollstreckbar.

Tatbestand

Die Beklagte ist eingetragene Inhaberin des auch mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland erteilten europäischen Patents EP 1 223 660, das am 18. September 2001 unter Inanspruchnahme der Priorität der japanischen Patentanmeldung JP 2000394725 vom 26. Dezember 2000 angemeldet worden ist. Das Streitpatent ist in der Verfahrenssprache Englisch veröffentlicht und wird beim Deutschen Patentund Markenamt unter der Nr. 601 01 365 geführt. Es betrifft einen Wechselstromgenerator für Fahrzeuge und ein Verfahren zur Herstellung eines Stators dafür und umfasst in der erteilten Fassung 10 Patentansprüche, von denen die Ansprüche 1, 2, 3, 5, 6, 7 und 8 angegriffen sind. Die Patentansprüche 1, 2 und 7 der erteilten Fassung lauten in der Verfahrenssprache Englisch wie folgt:

In der deutschen Übersetzung haben diese Patentansprüche folgenden Wortlaut:

1. Fahrzeugwechselstromgenerator, welcher aufweist: einen Rotor (7), der an einer Welle (6) fixiert ist, welche durch ein Gehäuse (3) drehbar gelagert ist; ein Kühlgebläse (5), welches zumindest an einem axialen Endabschnitt des Rotors (7) angeordnet ist; einen Stator (8), welcher versehen ist mit: einem zylindrischen Statorkern (15), bei dem sich axial erstreckende Schlitze (14) in einem Verhältnis von zwei pro Phase pro Pol ausgebildet sind, so dass diese sich in Umfangsrichtung aufreihen, wobei der Statorkern (15) durch ein Gehäuse (3) gelagert ist, so dass der Rotor (7) umgeben ist; und einer Statorwicklung (16), welche aus ersten und zweiten Dreiphasenwechselstromwicklungen (160A, 160B) aufgebaut ist, welche in dem Statorkern (15) installiert sind; und erste und zweite Gleichrichter (12A, 12B) zum Gleichrichten eines Wechselstroms, der von jeder der ersten und zweiten Dreiphasenwechselstromwicklungen (160A, 160B) ausgegeben wird, wobei die Schlitze (14) in einer Reihe von einem A-Phasenschlitz (14a), einem D-Phasenschlitz (14d), einem B-Phasenschlitz (14b), einem E-Phasenschlitz (14e), einem C-Phasenschlitz (14c) und einem F-Phasenschlitz (14f) in Umfangsrichtung wiederholt angeordnet sind; und wobei die Statorwicklung (16) mit A-Phasen, B-Phasen, C-Phasen, D-Phasen, E-Phasen und F-Phasenwicklungsphasenabschnitten (30a, 30b, 30c, 30d, 30e, 30f) versehen ist, wobei in jedem davon ein Leiterkabel (32), das mit elektrischer Isolierung beschichtet ist, in einer Wellenform in einer Schlitzgruppe installiert ist, welche durch Schlitze (14) von ähnlichen Phasen gebildet wird, so dass sie sich nach außen in einer axialen Richtung hinsichtlich des Statorkerns (15) von jedem vorgegebenen Schlitz (14) erstrecken, welche sich in Umfangsrichtung erstreckt, und welche in einen darauf folgenden Schlitz (14) von ähnlicher Phase eintreten; wobei die erste Dreiphasen-Wechselstromwicklung (160A) durch Ausbildung des A-Phasenwicklungsphasenabschnittes (30a) des B-Phasenwicklungsphasenabschnittes (30b) und des C-Phasenwicklungsphasenabschnittes (30c) in eine Wechselstromverbindung aufgebaut ist; wobei die zweite Dreiphasen-Wechselstromwicklung (160B) durch Ausbildung des D-Phasenwicklungsphasenabschnittes (30d), des E-Phasenwicklungsphasenabschnittes (30e) und des F-Phasenwicklungsphasenabschnittes (30f) in eine Wechselstromverbindung aufgebaut ist; wobei die A-Phasen, B-Phasen, C-Phasen, D-Phasen, E-Phasen und F-Phasenwicklungsphasenabschnitte (30a bis 30f) in den Statorkern (15) installiert sind, so dass sich diese radial in sechs Lagen aufreihen; und wobei die Wicklungsphasenabschnitte (30a, 30b, 30c), die die Dreiphasenwechselstromwicklung (160A) bilden, drei radial äußere Schichten bilden und wobei die Wicklungsphasenabschnitte (30d, 30e, 30f), welche die zweite Dreiphasenwechselstromwicklung (160B) bilden, die drei radial inneren Schichten bilden.

2. Fahrzeugwechselstromgenerator, welcher aufweist: einen Rotor (7), der an einer Welle (6) fixiert ist, welche durch ein Gehäuse (3 ) drehbar gelagert ist; ein Kühlgebläse (5), welches zumindest an einem axialen Endabschnitt des Rotors (7) angeordnet ist; einen Stator (8A), welcher versehen ist mit: einem zylindrischen Statorkern (15), bei dem sich axial erstreckende Schlitze (14) in einem Verhältnis von zwei pro Phase pro Pol ausgebildet sind, so dass diese sich in Umfangsrichtung aufreihen, wobei der Statorkern (15) durch ein Gehäuse

(3) gelagert ist, so dass der Rotor (7) umgeben ist; und einer Statorwicklung (16A), welche aus ersten und zweiten Dreiphasenwechselstromwicklungen (160A, 160B) aufgebaut ist, welche in dem Statorkern (15) installiert sind; und einen Gleichrichter (12) zum Gleichrichten eines Wechselstroms, welcher von der Statorwicklung (16A) ausgegeben wird, wobei die Schlitze (14) in einer Reihe von einem A-Phasenschlitz (14a), einem D-Phasenschlitz (14d), einem B-Phasenschlitz (14b), einem E-Phasenschlitz (14e), einem C-Phasenschlitz (14c) und einem F-Phasenschlitz (14f) in Umfangsrichtung wiederholt angeordnet sind; und wobei die Statorwicklung (16A) mit A-Phasen, B-Phasen, C-Phasen, D-Phasen, E-Phasen und F-Phasenwicklungsphasenabschnitten (40a, 40b, 40c, 40d, 40e, 40f) versehen ist, wobei in jedem davon ein Leiterkabel (32), das mit elektrischer Isolierung beschichtet ist, in einer Wellenform in einer Schlitzgruppe installiert ist, welche durch Schlitze (14) von ähnlichen Phasen gebildet wird, so dass sie sich nach außen in einer axialen Richtung hinsichtlich des Statorkerns (15) von jedem vorgegebenen Schlitz (14) erstrecken, welche sich in Umfangsrichtung erstreckt, und welche in einen darauf folgenden Schlitz (14) von ähnlicher Phase eintreten; wobei die erste Dreiphasen-Wechselstromwicklung (160A) durch Ausbildung des A-Phasenwicklungsphasenabschnittes (40a) des B-Phasenwicklungsphasenabschnittes (40b) und des C-Phasenwicklungsphasenabschnittes (40c) in eine Wechselstromverbindung aufgebaut ist; wobei die zweite Dreiphasen-Wechselstromwicklung (160B) durch Ausbildung des D-Phasenwicklungsphasenabschnittes (40d), des E-Phasenwicklungsphasenabschnittes (40e) und des F-Phasenwicklungsphasenabschnittes (40f) in eine Wechselstromverbindung aufgebaut ist; wobei die A-Phasen, B-Phasen, C-Phasen, D-Phasen, E-Phasen und F-Phasenwicklungsphasenabschnitte (40a bis 40f) in den Statorkern (15) installiert sind, so dass sich diese radial in sechs Lagen aufreihen; und wobei ein erster der Wicklungsphasenabschnitte (40a, 40b, 40c), welcher die erste Dreiphasenwechselstromwicklung (160A) bildet, einen von drei radial inneren Schichten bildet und wobei ein zweiter der Wicklungsphasenabschnitte (40a, 40b, 40c), welcher die erste Dreiphasenwechselstromwicklung (160B) bildet, eine der drei radial äußeren Schichten bildet.

(Das Bezugszeichen "160B" im letzten Merkmal lautet in Übereinstimmung mit dem englischen Original richtig "160A".)

7. Verfahren zur Herstellung eines Stators für einen Fahrzeugwechselstromgenerator, welches aufweist: einen ringförmigen Wicklungseinheitsbildungsvorgang zur Bildung einer ringförmigen Wicklungseinheit (33) durch Wicklung eines kontinuierlichen Kabels (32) in eine ringförmige Form mit einer vorbestimmten Anzahl von Windungen; einen sternförmigen Wicklungseinheitsbildungsprozess zur Bildung einer sternförmigen Wicklungseinheit (34) aus der ringförmigen Wicklungseinheit (33), wobei die sternförmige Wicklungseinheit (34) aus schlitzhäusigen Abschnitten (34a) aufgebaut ist, welche an einer gleichförmigen ringförmigen Unterteilung in Umfangsrichtung, welche abwechselnd durch Verbindungsabschnitte (34b) verbunden sind, an einer radial inneren Seite und einer radial äußeren Seite angeordnet sind; und einen Windungseinheitsinstallationsprozess zur Installation von sechs Phasen der sternförmigen Wicklungseinheit (34) in einem zylindrischen Statorkern (15), der mit Schlitzen (14) in einem Verhältnis von zwei pro Phase pro Pol ausgebildet ist, wobei der Wicklungseinheitsinstallationsprozess versehen ist mit: einem ersten Wicklungseinheitsinstallationsprozess zur Installierung eines ersten Satzes von drei Phasen der sternförmigen Wicklungseinheiten (34) in den zylindrischen Statorkern (15), so dass diese gestapelt werden und um einen vorbestimmten Betrag in Umfangsrichtung versetzt sind, und einem zweiten Wicklungseinheitsinstallationsprozess zum Installieren eines zweiten Satzes von drei Phasen der sternförmigen Wicklungseinheiten (34) in den zylindrischen Statorkern (15), so dass diese gestapelt werden und um einen vorbestimmten Betrag in Umfangsrichtung versetzt sind.

Wegen des Wortlauts der weiter angegriffenen und auf die Ansprüche 1 oder 2 rückbezogenen Ansprüche 3, 5 und 6 bzw. des auf Anspruch 7 rückbezogenen Anspruchs 8 wird auf die Streitpatentschrift EP 1 223 660 B1 bzw. auf die deutsche Übersetzung Bezug genommen.

Die Klägerin behauptet, die Gegenstände der Ansprüche 2 und 3 des Streitpatents seien wegen fehlender Neuheit gegenüber dem nächstkommenden nachveröffentlichten Stand der Technik und die Gegenstände aller angegriffenen Ansprüche seien wegen fehlender erfinderischer Tätigkeit nicht patentfähig. Hierzu bezieht sie sich insbesondere auf folgende Druckschriften und Dokumente:

K6 US 5 122 705 (entspricht JP 4-26345) K7 EP 1211 781 B1 K8 US 5 994802 K9 GB 2053580 K10 GB 922 929 K12 US 5 888778 Die Klägerin beantragt, das europäische Patent 1 223 660 für das Gebiet der Bundesrepublik Deutschland im Umfang der Patentansprüche 1, 2, 3 sowie 5, 6, 7 und 8, soweit diese nicht unmittelbar oder mittelbar auf Patentanspruch 4 rückbezogen sind, für nichtig zu erklären.

Die Beklagte beantragt, die Klage insgesamt abzuweisen, hilfsweise mit der Maßgabe, dass an die Stelle der erteilten Patentansprüche 1 bis 8, soweit angegriffen, folgende Patentansprüche 1 bis 5 treten (Hilfsantrag 1):

1. An automotive alternator comprising: a rotor (7) fixed to a shaft (6) rotatably supported by a case (3); a cooling fan (5) disposed on at least one axial end portion of said rotor (7); a stator (8A) provided with:

a cylindrical stator core (15) in which slots (14) extending axially are formed at a ratio of two per phase per pole so as to line up circumferentially, said stator core (15) being supported by said case (3) so as to envelop said rotor (7); and a stator winding (16A) composed of first and second threephase alternatingcurrent windings (160A, 160B) installed in said stator core (15); anda rectifier (12) for rectifying an alternatingcurrent output from said stator winding (16A), wherein said slots (14) are arranged in order of an aphase slot (14a), a dphase slot (14d), a bphase slot (14b), an ephase slot (14e), a cphase slot (14c), and an fphase slot (14f) repeatedly in a circumferential direction; said stator winding (16A) is provided with aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) in each of which a conductor wire (32) coated with electrical insulation is installed in a wave shape in a slot group constituted by slots (14) of like phase so as to extend outwards in an axial direction relative to said stator core (15) from any given slot (14), extend circumferentially, and enter a subsequent slot (14) of like phase; said first threephase alternatingcurrent winding (160A) is constructed by forming said aphase winding phase portion (40a), said bphase winding phase portion (40b), and said cphase winding phase portion (40c) into an alternating current connection; said second threephase alternatingcurrent winding (160B) is constructed by forming said dphase winding phase portion (40d), said ephase winding phase portion (40e), and said fphase winding phase portion (40f) into an alternating current connection; said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) are installed said stator core (15) so as to line up in six layers radially; and a first of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyinner layers and a second of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyouter layers.

The automotive alternator according to Claim 1 wherein said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) and said winding phase portions (40d, 40e, 40f) constituting said second threephase alternatingcurrent winding (160B) are lined up alternately in a radial direction.

The automotive alternator according to Claim 2 wherein said aphase winding phase portion (40a) and said ephase winding phase portion (40e) constitute a first pair of layers on an inner circumferential side, in an intermediate portion, or on an outer circumferential side in a radial direction, said bphase winding phase portion (40b) and said fphase winding phase portion (40f) constitute a second pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction, and said cphase winding phase portion (40c) and said dphase winding phase portion (40d) constitute a third pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction.

The automotive alternator according to any of Claims 1 to 3 wherein a coil end group (16f, 16r) of said stator winding (16A) is constituted by coil ends (41b) composed of portions of said conductor wires (32) extending outwards from any given slot (14), extending circumferentially, and entering a subsequent slot (14) of like phase, a varnish being impregnated into said coil end group.

5.

The automotive alternator according to any of Claims 1 to 4 wherein each of said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) is constituted by a divided winding portion.", weiter hilfsweise mit der Maßgabe, dass an die Stelle der erteilten Patentansprüche 1 bis 8, soweit angegriffen, die folgenden Ansprüche 1 bis 4 treten (Hilfsantrag 2):

"1. An automotive alternator comprising: a rotor (7) fixed to a shaft (6) rotatably supported by a case (3); a cooling fan (5) disposed on at least one axial end portion of said rotor (7); a stator (8A) provided with:

a cylindrical stator core (15) in which slots (14) extending axially are formed at a ratio of two per phase per pole so as to line up circumferentially, said stator core (15) being supported by said case (3) so as to envelop said rotor (7); and a stator winding (16A) composed of first and second threephase alternatingcurrent windings (160A, 160B) installed in said stator core (15); anda rectifier (12) for rectifying an alternatingcurrent output from said stator winding (16A), wherein said slots (14) are arranged in order of an aphase slot (14a), a dphase slot (14d), a bphase slot (14b) , an ephase slot (14e), a cphase slot (14c), and an fphase slot (14f) repeatedly in a circumferential direction; said stator winding (16A) is provided with aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) in each of which a conductor wire (32) coated with electrical insulation is installed in a wave shape in a slot group constituted by slots (14) of like phase so as to extend outwards in an axial direction relative to said stator core (15) from any given slot (14), extend circumferentially, and enter a subsequent slot (14) of like phase; said first threephase alternatingcurrent winding (160A) is constructed by forming said aphase winding phase portion (40a), said bphase winding phase portion (40b), and said cphase winding phase portion (40c) into an alternating current connection; said second threephase alternatingcurrent winding (160B) is constructed by forming said dphase winding phase portion (40d), said ephase winding phase portion (40e), and said fphase winding phase portion (40f) into an alternating current connection; said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) are installed said stator core (15) so as to line up in six layers radially; a first of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyinner layers and a second of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyouter layers; and each of said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c,40d, 40e, 40f) is constituted by a divided winding portion.

The automotive alternator according to Claim 1 wherein said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) and said winding phase portions (40d, 40e, 40f) constituting said second threephase alternatingcurrent winding (160B) are lined up alternately in a radial direction.

The automotive alternator according to Claim 2 wherein said aphase winding phase portion (40a) and said ephase winding phase portion (40e) constitute a first pair of layers on an inner circumferential side, in an intermediate portion, or on an outer circumferential side in a radial direction, said bphase winding phase portion (40b) and said fphase winding phase portion (40f) constitute a second pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction, and said cphase winding phase portion (40c) and said dphase winding phase portion (40d) constitute a third pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction.

The automotive alternator according to any of Claims 1 to 3 wherein a coil end group (16f, 16r) of said stator winding (16A) is constituted by coil ends (41b) composed of portions of said conductor wires (32) extending outwards from any given slot (14), extending circumferentially, and entering a subsequent slot (14) of like phase, a varnish being impregnated into said coil end group.", weiter hilfsweise mit der Maßgabe, dass an die Stelle der erteilten Patentansprüche 1 bis 8, soweit angegriffen, die folgenden Ansprüche 1 bis 4 treten (Hilfsantrag 3):

"1. An automotive alternator comprising: a rotor (7) fixed to a shaft (6) rotatably supported by a case (3); a cooling fan (5) disposed on at least one axial end portion of said rotor (7); a stator (8A) provided with:

said first threephase alternatingcurrent winding (160A) is constructed by forming said aphase winding phase portion (40a), said bphase winding phase portion (40b), and said cphase winding phase portion (40c) into an alternating current connection;

said second threephase alternatingcurrent winding (160B) is constructed by forming said dphase winding phase portion (40d), said ephase winding phase portion (40e), and said fphase winding phase portion (40f) into an alternating current connection; said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) are installed said stator core (15) so as to line up in six layers radially; andsaid winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) and said winding phase portions (40d,40e,40f) constituting said second threephase alternatingcurrent winding (160B) are lined up alternately in a radial direction.

The automotive alternator according to Claim 1 wherein said aphase winding phase portion (40a) and said ephase winding phase portion (40e) constitute a first pair of layers on an inner circumferential side, in an intermediate portion, or on an outer circumferential side in a radial direction, said bphase winding phase portion (40b) and said fphase winding phase portion (40f) constitute a second pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction, and said cphase winding phase portion (40c) and said dphase winding phase portion (40d) constitute a third pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction.

The automotive alternator according to any of Claims 1 or 2 wherein a coil end group (16f, 16r) of said stator winding (16A) is constituted by coil ends (41b) composed of portions of said conductor wires (32) extending outwards from any given slot (14), extending circumferentially, and entering a subsequent slot (14) of like phase, a varnish being impregnated into said coil end group.

4.

The automotive alternator according to any of Claims 1 to 3 wherein each of said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) is constituted by a divided winding portion.", weiter hilfsweise mit der Maßgabe, dass an die Stelle der erteilten Patentansprüche 1 bis 8, soweit angegriffen, die folgenden Ansprüche 1 bis 3 treten (Hilfsantrag 4):

"1. An automotive alternator comprising: a rotor (7) fixed to a shaft (6) rotatably supported by a case (3); a cooling fan (5) disposed on at least one axial end portion of said rotor (7); a stator (8A) provided with:

a cylindrical stator core (15) in which slots (14) extending axially are formed at a ratio of two per phase per pole so as to line up circumferentially, said stator core (15) being supported by said case (3) so as to envelop said rotor (7); and a stator winding (16A) composed of first and second threephase alternatingcurrent windings (160A, 160B) installed in said stator core (15); anda rectifier (12) for rectifying an alternatingcurrent output from said stator winding (16A), wherein said slots (14) are arranged in order of an aphase slot (14a), a dphase slot (14d), a bphase slot (14b), an ephase slot (14e), a cphase slot (14c), and an fphase slot (14f) repeatedly in a circumferential direction; said stator winding (16A) is provided with aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a ,40b ,40c , 40d ,40e ,40f) in each of which a conductor wire (32) coated with electrical insulation is installed in a wave shape in a slot group constituted by slots (14) of like phase so as to extend outwards in an axial direction relative to said stator core (15) from any given slot (14), extend circumferentially, and enter a subsequent slot (14) of like phase; said first threephase alternatingcurrent winding (160A) is constructed by forming said aphase winding phase portion (40a), said bphase winding phase portion (40b), and said cphase winding phase portion (40c) into an alternating current connection; said second threephase alternatingcurrent winding (160B) is constructed by forming said dphase winding phase portion (40d), said ephase winding phase portion (40e), and said fphase winding phase portion 40f) into an alternating current connection; said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) are installed said stator core (15) so as to line up in six layers radially; said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) and said winding phase portions (40d, 40e, 40f) constituting said second threephase alternatingcurrent winding (160B) are lined up alternately in a radial direction; and each of said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) is constituted by a divided winding portion.

The automotive alternator according to Claim 1 wherein said aphase winding phase portion (40a) and said ephase winding phase portion (40e) constitute a first pair of layers on an inner circumferential side, in an intermediate portion, or on an outer circumferential side in a radial direction, said bphase winding phase portion (40b) and said fphase winding phase portion (40f) constitute a second pair of layers on said inner circumferentialside, in said intermediate portion, or on said outer circumferential side in said radial direction, and said cphase winding phase portion (40c) and said dphase winding phase portion (40d) constitute a third pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction.

The automotive alternator according to any of Claims 1 or 2 wherein a coil end group (16f, 16r) of said stator winding (16A) is constituted by coil ends (41b) composed of portions of said conductor wires (32) extending outwards from any given slot (14), extending circumferentially, and entering a subsequent slot (14) of like phase, a varnish being impregnated into said coil end group.", weiter hilfsweise mit der Maßgabe, dass an die Stelle der erteilten Patentansprüche 1 bis 8, soweit angegriffen, die folgenden Ansprüche 1 bis 4 treten (Hilfsantrag 5):

"1. An automotive alternator comprising: a rotor (7) fixed to a shaft (6) rotatably supported by a case (3); a cooling fan (5) disposed on at least one axial end portion of said rotor (7); a stator (8A) provided with:

a cylindrical stator core (15) in which slots (14) extending axially are formed at a ratio of two per phase per pole so as to line up circumferentially, said stator core (15) being supported by said case (3) so as to envelop said rotor (7); and a stator winding (16A) composed of first and second threephase alternatingcurrent windings (160A, 160B) installed in said stator core (15); and a rectifier (12) for rectifying an alternatingcurrent output from said stator winding (16A), wherein said slots (14) are arranged in order of an aphase slot (14a), a dphase slot (14d), a bphase slot (14b), an ephase slot (14e), a cphase slot (14c), and an fphase slot (14f) repeatedly in a circumferential direction; said stator winding (16A) is provided with aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a ,40b, 40c, 40d, 40e, 40f) in each of which a conductor wire (32) coated with electrical insulation is installed in a wave shape in a slot group constituted by slots (14) of like phase so as to extend outwards in an axial direction relative to said stator core (15) from any given slot (14), extend circumferentially, and enter a subsequent slot (14) of like phase; said first threephase alternatingcurrent winding (160A) is constructed by forming said aphase winding phase portion (40a), said bphase winding phase portion (40b), and said cphase winding phase portion (40c) into an alternating current connection; said second threephase alternatingcurrent winding (160B) is constructed by forming said dphase winding phase portion (40d), said ephase winding phase portion (40e), and said fphase winding phase portion (40f) into an alternating current connection; said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) are installed said stator core (15) so as to line up in six layers radially; and a first of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyinner layers and a second of said winding phase portions (40a,40b,40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyouter layers, wherein a coil end group (16f, 16r) of said stator winding (16A) is constituted by coil ends (41b) composed of portions of said conductor wires (32) extending outwards from any given slot (14), extending circumferentially, and entering a subsequent slot (14) of like phase, a varnish being impregnated into said coil end group.

The automotive alternator according to Claim 1 wherein said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) and said winding phase portions (40d, 40e, 40f) constituting said second threephase alternatingcurrent winding (160B) are lined up alternately in a radial direction.

The automotive alternator according to Claim 2 wherein said aphase winding phase portion (40a) and said ephase winding phase portion (40e) constitute a first pair of layers on an inner circumferential side, in an intermediate portion, or on an outer circumferential side in a radial direction, said bphase winding phase portion (40b) and said fphase winding phase portion (40f) constitute a second pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction, and said cphase winding phase portion (40c) and said dphase winding phase portion (40d) constitute a third pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction.

The automotive alternator according to any of Claims 1 to 3 wherein each of said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) is constituted by a divided winding portion.", weiter hilfsweise mit der Maßgabe, dass an die Stelle der erteilten Patentansprüche 1 bis 8, soweit angegriffen, die folgenden Ansprüche 1 bis 3 treten (Hilfsantrag 6):

The automotive alternator according to Claim 1 wherein said aphase winding phase portion (40a) and said ephase winding phase portion (40e) constitute a first pair of layers on an inner circumferential side, in an intermediate portion, or on an outer circumferential side in a radial direction, said bphase winding phase portion (40b) and said fphase winding phase portion (40f) constitute a second pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction, and said cphase winding phase portion (40c) and said dphase winding phase portion (40d) constitute a third pair of layers on said inner circumferential side, in said intermediate portion, or on said outer circumferential side in said radial direction."

Das von der Klägerin erstmals in der mündlichen Verhandlung vorgebrachte Angriffsmittel in Form der Druckschrift DE 195 29 392 A1 wurde gem. § 83 Abs. 4 PatG als verspätet zurückgewiesen.

Gründe

Die zulässige Klage ist begründet. Das Streitpatent ist, soweit angegriffen, weder in der erteilten Fassung noch in der Fassung eines der Hilfsanträge patentfähig (Art. II § 6 Abs. 1 Nr. 1 IntPatÜG, Art. 138 Abs. 1 Buchst. a, Art. 56 EPÜ). Denn der Gegenstand des Streitpatents ist sowohl in der erteilten Fassung als auch in den hilfsweise verteidigten Fassungen durch den Stand der Technik und die Kenntnisse des hier einschlägigen Fachmanns, eines Fachhochschulingenieurs der Elektrotechnik mit mehrjähriger Berufserfahrung in der Entwicklung von Fahrzeuggeneratoren, nahegelegt.

I.

Das Streitpatent betrifft einen Wechselstromgenerator für Fahrzeuge und ein Verfahren zur Herstellung eines Stators für solche Generatoren.

1. Nach Angaben der Streitpatentschrift sind im Stand der Technik Fahrzeugwechselstromgeneratoren bekannt, die im Allgemeinen folgendes umfassen: einen Stator, welcher durch Installieren einer Statorwicklung in einen zylindrischen Statorkern konstruiert ist, in welchem sich Schlitze (englisch "slots" deutscher Fachbegriff "Nuten") axial erstrecken und in einem gleichmäßigen Winkelabstand in einer Umfangsrichtung ausgebildet sind; und einen Rotor mit einer Feldwicklung, die an einer inneren Umfangsseite des Stators angeordnet ist. Die Schlitze sind in dem Statorkern in einem Verhältnis von eins pro Phase pro Pol proportional zur Anzahl der Phasen in der Statorwicklung und der Anzahl der magnetischen Pole in dem Rotor angeordnet [Abs. 0003 der DE 601 01 365].

Als nachteilig wird dort beschrieben, dass wenn die Schlitze in einem Verhältnis von eins pro Phase pro Pol in dieser Art und Weise angeordnet sind, die Zeitdauer lang sei, in der ein Zahn, der zwischen den Schlitzen angeordnet ist, ein angrenzendes Paar von magnetischen Polen relativ zu einer axialen Richtung überlappt, was zu einer erhöhten magnetischen Flussleckage führe. Diese magnetische Flussleckage bzw. der Verlust des magnetischen Flusses reduziere den effektiven magnetischen Fluss und führe zu Fluktuationen in der erzeugten Spannung was in einem Brummen resultiere, wenn der Wechselstrom in einen Gleichstrom umgewandelt wird [Abs. 0004].

Aus diesem Grund lehre etwa die japanische Schrift HEI 4-26345, die magnetische Flussleckage durch Anordnen von Schlitzen in einem Verhältnis von zwei pro Phase pro Pol zu reduzieren, um die Zeitdauer zu verkürzen, wobei ein Zahn ein angrenzendes Paar von magnetischen Polen relativ zu der radialen Richtung überlappe [Abs. 0005]. Diese japanische Schrift offenbare aber nicht die Konstruktion der Statorwicklung im Einzelnen, zudem könne bei Konstruktion einer Statorwicklung unter Verwendung von sternenförmigen Wicklungseinheiten, wobei eine ringförmige Wicklungseinheit vorgesehen ist, bei der ein Leiterkabel für eine vorbestimmte Anzahl von Windungen bzw. Wicklungen gewunden ist, ein Kurzschluss leichter zwischen den Wicklungsenden in den Wicklungsendgruppen (deutscher Fachbegriff "Wickelkopf") der Statorwicklung auftreten. Außerdem führe ein Kurzschluss zwischen den ersten und zweiten Wechselstromwicklungen zu einer geringen Leistungserzeugung [Abs. 0012] und es könne die Aufreihung der Wicklungseinheiten in sechs radialen Schichten zu thermischen Problemen, verbunden mit einer verminderten Leistungsabgabe, führen [Abs. 0013].

Als Aufgabe ist angegeben, die vorstehenden Probleme zu lösen und einen Fahrzeugwechselstromgenerator bereit zu stellen, der eine verminderte Leistungserzeugung ("output", übersetzt mit "Abgabe" bzw. "Ausgabe") dadurch verhindere, dass eine Statorwicklung unter Verwendung von sternenförmigen Wicklungseinheiten unter dem Blickwinkel der Verbesserung der Statorherstellungsrate und reduzierter Kosten geschaffen werde; ferner solle ein Verfahren zur Herstellung eines derartigen Stators bereitgestellt werden [Abs. 0015].

2. Hierzu beschreibt das Streitpatent in Anspruch 1 einen Fahrzeugwechselstromgenerator mit folgenden Merkmalen (und einer eingefügten Gliederung):

1. An automotive alternator comprising: Fahrzeugwechselstromgenerator, welcher aufweist:

1.1 a rotor (7) fixed to a shaft (6) rotatably supported by a case (3);

einen Rotor (7), der an einer Welle (6) fixiert ist, welche durch ein Gehäuse (3) drehbar gelagert ist;

1.2 a cooling fan (5) disposed on at least one axial end portion of said rotor (7);

ein Kühlgebläse (5), welches zumindest an einem axialen Endabschnitt des Rotors (7) angeordnet ist;

1.3 a Stator (8A) provided with: einen Stator (8), welcher versehen ist mit:

1.3.1 a cylindrical Stator core (15) in which slots (14) extending axially are formed at a ratio of two per phase per pole so as to line up circumferentially, said Stator core (15) being supported by said case (3) so as to envelop said rotor (7); andeinem zylindrischen Statorkern (15), bei dem sich axialerstreckende Schlitze (14) in einem Verhältnis von zwei pro Phase pro Pol ausgebildet sind, so dass diese sich in Umfangsrichtung aufreihen, wobei der Statorkern (15) durch ein Gehäuse (3) gelagert ist, so dass der Rotor (7) umgeben ist; und 1.3.2 a stator winding (16) composed of first and second threephase alternatingcurrent windings (160A, 160B) installed in said stator core (15); and einer Statorwicklung (16), welche aus ersten und zweiten Dreiphasenwechselstromwicklungen (160A, 160B) aufgebaut ist, welche in dem Statorkern (15) installiert sind; und 1.4 first and second rectifiers (12A, 12B) for rectifying an alternatingcurrent output from each of said first and second three phase alternatingcurrent windings (160A, 160B), erste und zweite Gleichrichter (12A, 12B) zum Gleichrichten eines Wechselstroms, der von jeder der ersten und zweiten Dreiphasenwechselstromwicklungen (160A, 160B) ausgegeben wird, 1.5 wherein said slots (14) are arranged in order of an aphase slot (14a), a dphase slot (14d), a bphase slot (14b), an ephase slot (14e), a cphase slot (14c), and an fphase slot (14f) repeatedly in a circumferential direction; wobei die Schlitze (14) in einer Reihe von einem A-Phasenschlitz (14a), einem D-Phasenschlitz (14d), einem B-Phasenschlitz (14b), einem E-Phasenschlitz (14e), einem C-Phasenschlitz (14c) und einem F-Phasenschlitz (14f) in Umfangsrichtung wiederholt angeordnet sind;

Der Anspruch 2, der dem Anspruch 1 nach Hilfsantrag 1 entspricht, unterscheidet sich vom Anspruch 1 durch die Merkmale 2.4 und 2.11. Er lautet (mit der Korrektur des fehlerhaften Bezugszeichens im Merkmal 2.11):

2.0 An automotive alternator comprising:

2.10 said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) are installed said stator core (15) so as to line up in six layers radially; wobei die A-Phasen, B-Phasen, C-Phasen, D-Phasen, E-Phasen und F-Phasenwicklungsphasenabschnitte (40a bis 40f) in den Statorkern (15) installiert sind, so dass sich diese radial in sechs Lagen aufreihen; und 2.11 a first of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyinner layers and a second of said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) constitutes one of three radiallyouter layerswobei ein erster der Wicklungsphasenabschnitte (40a, 40b, 40c), welcher die erste Dreiphasenwechselstromwicklung (160A) bildet, einen von drei radial inneren Schichten bildet und wobei ein zweiter der Wicklungsphasenabschnitte (40a, 40b, 40c), welcher die erste Dreiphasenwechselstromwicklung (160A) bildet, eine der drei radial äußeren Schichten bildet.

Im Anspruch 1 nach Hilfsantrag 3 (und entsprechend in den Hilfsanträgen 4, 7 und 8) wurde das Merkmal 2.11 durch das Merkmal 2.12, das dem erteilten Anspruch 3 entspricht, ersetzt:

2.12 said winding phase portions (40a, 40b, 40c) constituting said first threephase alternatingcurrent winding (160A) and said winding phase portions (40d, 40e,40f) constituting said second threephase alternatingcurrent winding (160B) are lined up alternately in a radial directionwobei die Wicklungsphasenabschnitte (40a, 40b, 40c), welche die erste Dreiphasenwechselstromwicklung (160A) bilden, und die Wicklungsphasenabschnitte (40d, 40e, 40f), welche die zweite Dreiphasenwechselstromwicklung (160B) bilden, abwechselnd in radialer Richtung aufgereiht sind.

In den weiteren Hilfsanträgen wurden die Merkmale:

2.13 each of said aphase, bphase, cphase, dphase, ephase, and fphase winding phase portions (40a, 40b, 40c, 40d, 40e, 40f) is constituted by a divided winding portion, wobei die A-Phasen, B-Phasen, C-Phasen, D-Phasen, E-Phasen und F-Phasenwicklungsphasenabschnitte (40a bis 40f) durch einen geteilten Wicklungsabschnitt gebildet wird, beziehungsweise 2.14 wherein a coil end group (16f, 16r) of said stator winding (16A) is constituted by coil ends (41b) composed of portions of said conductor wires (32) extending outwards from any given slot (14), extending circumferentially, and entering a subsequent slot (14) of like phase, a varnish being impregnated into said coil end group, wobei eine Spulenendgruppe (16f ,16r) der Statorwicklung (16A) durch Spulenenden (41b) gebildet wird, die aus Abschnitten der Leiterkabel aufgebaut sind, welche sich nach außen und jedem vorgegebenen Schlitz (14) erstrecken, der sich in Umfangsrichtung erstreckt, und einen darauf folgenden Schlitz (14) von ähnlichen Phasen eintreten, wobei ein Lack in die Spulen in Gruppen imprägniert wird, die den erteilten Ansprüchen 6 und 5 entsprechen, nach folgendem Schema angefügt:

3. Einige Merkmale der Ansprüche bedürfen näherer Erläuterung:

Die in den Ansprüchen 1 und 2 sich entsprechenden Merkmale werden im Folgenden ohne die führende Ziffer angegeben, also Merkmal 1.7 und 2.7 = Merkmal 7, Merkmal 1.3.1 und Merkmal 2.3.1 = Merkmal 3.1 usw..

Bei einem Verhältnis von zwei Schlitzen pro Pol und Phase nach Merkmal 3.1 und einem dreiphasigen Generator ergeben sich 6 Schlitze pro Pol, in denen jeweils eine Spulenseite der 2 x 3 = 6 Phasen von zwei Dreiphasenwicklungen angeordnet ist (im Unterschied zur "klassischen" Drehstrom-Zweischichtwicklung mit jeweils zwei Spulenseiten, auch unterschiedlicher Phasen, pro Schlitz). Dann kann man jeden der sechs Schlitze einer Phase zuordnen, wie im Merkmal 5 mit dem Begriff "A-Phasenschlitz" usw. geschehen. Dieses Schema wiederholt sich dann mit den nächsten 6 Schlitzen unter dem nächsten Pol usw. (Merkmal 5, "wiederholt angeordnet"). Bei den für Fahrzeuggeneratoren üblichen 12 Polen ergibt das insgesamt 72 Schlitze. Die Schlitze sind dabei um einen elektrischen Winkel von 30¡ versetzt (Abs. 0055; der elektrische Winkel ist ein Fachausdruck; er ist der mit der Polpaarzahl multiplizierte mechanische Winkel, so dass eine Polbreite einem elektrischen Winkel von 180¡ entspricht). Dabei sind auch die beiden Dreiphasenwechselstromwicklungen um einen elektrischen Winkel von 30¡, also eine Schlitzteilung versetzt, die Spulenseiten einer Wicklung um einen elektrischen Winkel von 60¡ (Abs. 0060) gleich zwei Schlitzteilungen.

"Leiterkabel" in Merkmal 7 ist eine missverständliche, und "Litze" (Abs. 0068) eine falsche Übersetzung von "conductor wire" (Streit-PS, Sp. 29, Z. 4, 5). Der Fachmann versteht darunter einen üblichen (lackisolierten) Wicklungsdraht.

Nach Merkmal 7 soll die Wicklung Wellenform haben. Der deutsche Fachbegriff ist Wellenwicklung. Eine solche Wicklung ist in Figur 3 dargestellt, und unterscheidet sich von der Alternative "Schleifenwicklung" (Druckschrift K8, Fig. 3) dadurch, dass sie einen Einzelpol nicht komplett, sondern nur U-förmig umfasst und dann gleich zum nächsten Pol weitergeht. Erst nach einem Durchlauf über alle Pole ergibt sich eine geschlossene Wicklung. Da unter jedem Pol die gleiche Konfiguration vorliegt, ist mit einer Schlitzgruppe, welche durch Schlitze von ähnlichen Phasen ("like phase") gebildet wird, die Schlitzgruppe für die gleiche Phase gemeint. Der darauf folgende Schlitz von ähnlicher Phase (Ende Merkmal 7) ist demnach der zur gleichen Phase gehörige Schlitz unter dem nächsten Pol.

Die Merkmale 8 und 9 geben die Aufteilung der Wicklung in zwei Dreiphasenwicklungen mit jeweils drei Phasenwicklungsabschnitten an. Die Namensgebung in A -B -usw. ist beliebig austauschbar, solange die Zugehörigkeit zu den beiden Dreiphasenwicklungen erkennbar bleibt, da sich die Phasenwicklungsabschnitte nicht unterscheiden.
